Terms of Service

1. Introduction

Welcome to Amour. These Terms of Service (“Terms”) govern your access to and use of the Amour mobile application, website, and all related services, features, and content (collectively, the “Service”) provided by TurtleByte (“we”, “us”, “our”, “Company”).

By creating an account or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree to these Terms, do not use the Service.

Please read these Terms carefully, particularly the sections on Limitation of Liability (Section 13) and Dispute Resolution (Section 14).

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other appropriate means before the changes take effect. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Service and delete your account.

2. Eligibility

To use Amour, you must:

  • Be at least 18 years of age
  • Be legally competent to enter into a binding contract under the Indian Contract Act, 1872
  • Not have been previously removed, suspended, or banned from the Service
  • Not have been convicted of, or pled guilty to, any offence involving violence, sexual misconduct, or harassment
  • Not be prohibited from using the Service under any applicable law

By creating an account, you represent and warrant that you meet all of the above requirements. If at any time you cease to meet these requirements, you must immediately stop using the Service and delete your account.

3. Your Account

3.1 Account Creation

To use the Service, you must create an account by providing accurate and complete information, including your email address and date of birth. You may also sign in using Google or Apple.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must immediately notify us at privacy-amour@turtlebyte.in if you suspect unauthorized access to your account.

3.3 Account Authenticity

You must:

  • Provide truthful and accurate information in your profile
  • Include at least one photograph that clearly shows your face
  • Not impersonate any other person or misrepresent your identity, age, or affiliations
  • Not create or maintain more than one account
  • Not transfer, sell, or assign your account to any other person

3.4 Verification

Amour offers two verification paths:

  • Aadhaar Verification: Full identity verification using your Aadhaar number through our authorized KYC provider, Sandbox Technologies. Aadhaar-verified users receive full access to all features.
  • Manual Verification: Basic identity verification using your name, date of birth, and sexual orientation. Manually verified users have access to limited features (viewing and liking profiles only).

You understand that verification status affects your access to features including video calls, audio calls, subscriptions, and reporting.

4. User Conduct

4.1 General Responsibilities

When using the Service, you agree to:

  • Comply with these Terms, our Community Guidelines, and all applicable laws
  • Treat other users with respect and dignity
  • Use the Service only for its intended purpose of forming genuine personal connections
  • Be solely responsible for your interactions with other users

4.2 Prohibited Content

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you must not host, display, upload, publish, transmit, store, or share any information or content that:

  1. Belongs to another person and to which you do not have any right
  2. Is obscene, pornographic, paedophilic, invasive of another person's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, or promotes enmity between different groups on the grounds of religion or caste with the intent to incite violence
  3. Is harmful to a child
  4. Infringes any patent, trademark, copyright, or other proprietary right
  5. Deceives or misleads the recipient about the origin of the message, or is patently false and untrue and is communicated with the intent to mislead or harass, or contains information that is patently false or misleading but is presented as fact
  6. Impersonates another person
  7. Threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order
  8. Contains any software virus or other computer code designed to interrupt, destroy, or limit the functionality of any computer resource
  9. Violates any law in force in India

4.3 Prohibited Actions

You must not:

  • Use the Service for any commercial purpose, including soliciting, advertising, or promoting products or services
  • Harass, stalk, threaten, intimidate, or abuse any user
  • Send unsolicited or unauthorized promotional messages or spam
  • Use any automated means (bots, crawlers, scrapers) to access or interact with the Service
  • Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to collect personal information about other users without their consent
  • Interfere with the proper functioning of the Service
  • Share your account credentials with any third party
  • Use the Service while under the influence of substances that impair your judgement during video or audio calls
  • Engage in any activity that could damage, disable, or impair the Service

5. Content

5.1 Your Content

You retain ownership of the content you create and share on the Service (“Your Content”), including profile information, photographs, audio, messages, and other materials. By sharing Your Content on the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to use, reproduce, modify, adapt, distribute, and display Your Content solely for the purpose of operating, improving, and promoting the Service.

This licence continues for as long as your account is active and for a reasonable period thereafter to allow for the removal of cached or archived content, except for content that has been shared with other users or incorporated into the Service in a way that cannot be practically removed (such as messages already delivered to other users).

5.2 Content Standards

Your Content must comply with Section 4.2 (Prohibited Content) and our Community Guidelines. We reserve the right to remove any content that violates these Terms or that we reasonably believe is harmful, offensive, or otherwise objectionable.

5.3 Content Moderation

We use a combination of automated tools and human review to moderate content on the Service. Our content moderation practices are designed to:

  • Detect and remove prohibited content
  • Identify and prevent fake or fraudulent accounts
  • Enforce our Community Guidelines
  • Respond to user reports

In accordance with the IT Rules 2021, we will:

  • Acknowledge user complaints regarding content within 24 hours
  • Remove or disable access to content that violates applicable law within 36 hours of receiving a complaint
  • Remove content depicting nudity or sexual content within 24 hours of receiving a complaint
  • Inform users whose content is removed about the reason for removal and provide an opportunity to respond

Users who submit manifestly unfounded or abusive reports may face enforcement action against their own accounts.

5.4 Our Content

All intellectual property rights in the Service, including but not limited to the App's design, logos, trademarks, source code, algorithms, and proprietary technology, are owned by or licensed to TurtleByte. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Service without our prior written consent.

5.5 Other Users' Content

Content shared by other users on the Service belongs to those users. You may not copy, download, distribute, or use another user's content for any commercial purpose or in any way that violates their rights or these Terms.

6. Reporting and Safety

6.1 Reporting Violations

If you encounter content or behaviour that violates these Terms, our Community Guidelines, or applicable law, you can report it through the in-app reporting mechanism. We take all reports seriously and will investigate them promptly.

6.2 Cooperation with Law Enforcement

We cooperate with law enforcement authorities in accordance with applicable Indian law, including the Information Technology Act, 2000 and the Bharatiya Nyaya Sanhita. We may disclose user data when required by law, court order, or government request.

6.3 No Background Checks

We do not conduct criminal background checks on users. While we offer identity verification through Aadhaar and manual methods, this does not constitute a guarantee of any user's character, conduct, or trustworthiness.

You are solely responsible for your safety when interacting with other users, both online and offline. We encourage you to follow our Safety Tips and exercise caution when meeting someone in person for the first time.

6.4 Safety Features

We provide various safety features within the Service, including blocking, reporting, and content moderation. These features are tools to assist you, not substitutes for personal caution. We do not guarantee that the Service will be free from harmful or objectionable users or content.

7. Purchases and Subscriptions

7.1 In-App Purchases

Amour may offer premium features, subscriptions, and virtual items available for purchase within the App (“Purchases”). All Purchases are processed through the Google Play Store or Apple App Store and are subject to the respective store's terms and refund policies.

7.2 Subscriptions

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. To cancel a subscription:

  • Android: Cancel through the Google Play Store subscription settings
  • iOS: Cancel through the Apple App Store subscription settings

Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until the end of the period you have already paid for.

7.3 Refunds

Refund requests are handled in accordance with the refund policies of the Google Play Store or Apple App Store, as applicable. If you believe you are entitled to a refund that is not covered by the store's policy, contact us at privacy-amour@turtlebyte.in.

7.4 Price Changes

We may change the price of Purchases at any time. Price changes will not affect active subscriptions until the next renewal period. We will notify you of price changes in advance.

7.5 Virtual Items

Virtual items (such as boosts, super likes, or other in-app features) are non-transferable, have no monetary value outside the Service, and cannot be exchanged for cash. Virtual items are consumed upon use and are generally non-refundable, subject to applicable consumer protection laws.

8. Privacy

Your privacy is important to us. Our collection, use, and sharing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Service, you consent to the practices described in our Privacy Policy.

9. Third-Party Services

The Service may integrate with or contain links to third-party services, including but not limited to:

  • GetStream for chat messaging and video/audio calls
  • Google and Apple for authentication
  • RevenueCat for subscription management
  • Google Play Store and Apple App Store for app distribution and payments

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, content, or practices of third-party services.

10. Account Suspension and Termination

10.1 By You

You may delete your account at any time through the App settings. Deleting your account will:

  • Make your profile invisible to other users immediately
  • Initiate the data deletion process as described in our Privacy Policy
  • Not automatically cancel any active subscriptions — you must cancel subscriptions separately through the Google Play Store or Apple App Store

10.2 By Us

We may suspend or terminate your account at our discretion, with or without notice, if:

  • You violate these Terms or our Community Guidelines
  • We reasonably believe your conduct poses a risk to other users or the integrity of the Service
  • We are required to do so by law
  • Your account has been inactive for two years

In cases of serious violations (including but not limited to harassment, fraud, or illegal activity), we may terminate your account immediately and permanently ban you from the Service. Banned users may also be reported to law enforcement where appropriate.

11. Intellectual Property

11.1 Our Intellectual Property

The Service, including its design, features, content, trademarks, logos, and underlying technology, is the intellectual property of TurtleByte and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, the Patents Act, 1970, and other applicable intellectual property laws of India.

11.2 Copyright Complaints

If you believe that your copyrighted work has been used on the Service in a way that constitutes infringement, please notify us at privacy-amour@turtlebyte.in with the following information:

  • Identification of the copyrighted work you believe is being infringed
  • Identification of the material on the Service that you believe is infringing
  • Your contact information (name, address, email)
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

We will review and respond to valid copyright complaints in accordance with applicable law.

12. Disclaimers

12.1 Service Provided “As Is”

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12.2 No Guarantees

We do not guarantee that:

  • The Service will be uninterrupted, error-free, or secure
  • Any defects will be corrected
  • The Service will meet your expectations or requirements
  • You will find compatible matches or form successful relationships
  • The number of active users in your area will meet your expectations
  • The information provided by other users is accurate, truthful, or complete

12.3 User Interactions

We are not responsible for the conduct of any user, whether online or offline. You agree to exercise caution, common sense, and personal judgement in all interactions with other users.

13. Limitation of Liability

13.1 Liability Cap

To the maximum extent permitted by applicable law, TurtleByte's total aggregate liability to you for all claims arising out of or relating to the Service or these Terms shall not exceed the amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or INR 5,000, whichever is greater.

13.2 Exclusion of Damages

To the maximum extent permitted by applicable law, TurtleByte shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or relating to:

  • Your use of or inability to use the Service
  • Any conduct or content of other users
  • Unauthorized access to or alteration of your data
  • Any third-party services or content accessed through the Service

13.3 Consumer Protection

Nothing in these Terms is intended to exclude or limit any rights you may have under the Consumer Protection Act, 2019 or any other applicable consumer protection law. If any provision of these Terms is found to constitute an unfair contract term under Section 2(46) of the Consumer Protection Act, 2019, that provision shall be severable and the remaining Terms shall continue in full force and effect.

14. Dispute Resolution

14.1 Informal Resolution

If you have a dispute with us, we encourage you to first contact us at privacy-amour@turtlebyte.in so we can attempt to resolve it informally. We will make reasonable efforts to resolve your concern within 30 days of receiving your complaint.

14.2 Grievance Officer

In accordance with the Information Technology Act, 2000 and the IT (Intermediary Guidelines) Rules, 2021, our Grievance Officer is:

The Grievance Officer will acknowledge your complaint within 24 hours and resolve it within 15 days of receipt, or within one month for complex matters.

14.3 Arbitration

If the dispute cannot be resolved informally, either party may elect to resolve the dispute through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be:

  • Conducted by a sole arbitrator mutually agreed upon by both parties
  • Held in Bangalore, Karnataka, India
  • Conducted in the English language
  • Governed by the substantive laws of India

The arbitrator's decision shall be final and binding on both parties, subject to the provisions of the Arbitration and Conciliation Act, 1996.

14.4 Consumer Forum Rights

Nothing in this Section 14 restricts your right to approach the appropriate Consumer Disputes Redressal Commission (District, State, or National) under the Consumer Protection Act, 2019. Your statutory rights as a consumer are fully preserved.

14.5 Small Claims

For disputes involving amounts below the pecuniary jurisdiction of the District Consumer Disputes Redressal Commission, you may also approach the appropriate civil court.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to:

  • The Indian Contract Act, 1872
  • The Information Technology Act, 2000
  • The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
  • The Consumer Protection Act, 2019
  • The Digital Personal Data Protection Act, 2023

Subject to Section 14.4 (Consumer Forum Rights), any legal proceedings arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

16. Indemnification

You agree to indemnify, defend, and hold harmless TurtleByte, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Service
  • Your Content
  • Your violation of these Terms or any applicable law
  • Your interaction with other users
  • Any third-party claims arising from your conduct on the Service

This indemnification obligation shall survive the termination of your account and these Terms.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and TurtleByte with respect to the Service and supersede all prior or contemporaneous agreements, representations, and understandings.

17.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any provision shall be effective only if made in writing and signed by TurtleByte.

17.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

17.5 No Third-Party Beneficiaries

These Terms do not create any rights for any third party. No person other than you and TurtleByte has any right to enforce any provision of these Terms.

17.6 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, epidemics, government actions, internet or telecommunications failures, or power outages.

17.7 Notices

We may provide notices to you through the App, by email to the address associated with your account, or by any other reasonable means. You may provide notices to us by emailing privacy-amour@turtlebyte.in or by writing to our registered address.

17.8 Language

These Terms are drafted in English. In accordance with the IT Rules 2021 and the DPDP Act, we will make these Terms available in additional languages as specified in the Eighth Schedule of the Constitution of India, as and when required. If these Terms are translated into any other language, the English version shall prevail in the event of any conflict or inconsistency.

17.9 Annual Reminder

In accordance with the IT (Intermediary Guidelines) Rules 2021, we will remind users of these Terms, our Privacy Policy, and Community Guidelines at least once every year.
